Marina Prilutskaya, with a Russian passport, really wants to work in Ukrainian government agencies.
The Ministry of Justice proved in court the legality of the dismissal of official Marina Prilutskaya (pictured above), who, according to the Security Service of Ukraine, voluntarily received Russian citizenship. Ukrayinska Pravda writes about this with reference to a message from the press service of the Ministry of Justice.
“The team of the Ministry of Justice in the Sixth Administrative Court of Appeal proved the legality of the dismissal in 2021 of an official who, according to the Security Service of Ukraine, on her own initiative received Russian citizenship,” the statement said.
On April 9, 2024, the panel of judges of the Sixth Administrative Court of Appeal left the complaint of ex-official Marina Prilutskaya unsatisfied.
At the same time, it is noted that this decision can be appealed to the Supreme Court.
The Supreme Court has already made a decision that opened the way for the complainant to be reinstated in the Ministry of Justice. However, the Ministry was categorically against this.
The complainant’s lawyers, as evidence, provided the court with a certificate from the “Main Directorate of the Ministry of Internal Affairs of the Russian Federation for the city of Moscow” stating that the ex-official does not have a Russian passport, which contains errors.
The Security Service of Ukraine lifted the secrecy and granted permission to transfer to the media part of the documents indicating the voluntary acquisition of Russian citizenship by Marina Prilutskaya.
The publication recalls that in July 2021, Marina Prilutskaya filed a claim with the District Administrative Court of Kiev against the Ministry of Justice of Ukraine to declare unlawful and cancel the order of her dismissal from office due to the loss of the right to public service or its limitation due to the establishment of the fact of having a civil servant of foreign citizenship during public service.
By the decision of the District Administrative Court of Kyiv dated May 20, 2022, left unchanged by the decision of the Sixth Administrative Court of Appeal dated November 9, 2022, Marina Prilutskaya’s claim was completely denied.
At the same time, the Cassation Administrative Court of the Supreme Court actually indicated that a photocopy of the Russian passport provided by the SBU and the tax number are not enough.
According to the decision of the Supreme Court, the Sixth Administrative Court of Appeal is considering the case again.
The Ministry of Justice asked the High Council of Justice to bring to disciplinary action the panel of Supreme Court judges who paved the way for Prilutskaya’s return to office.
