The regional economic court decided to return a land plot in the Novobavarsky district of Kharkov worth more than 1 million UAH to communal ownership.
This was reported by the press service of the Kharkov regional prosecutor's office.
According to the prosecutor's office, in 2020, one of the notaries operating in Kharkov, in the absence of any title documents, illegally registered ownership of two non-residential buildings with a total area of 35 square meters. m on a plot of land in the Novobavarsky district for a “front” individual.
Subsequently, these buildings, contrary to legal requirements, were resold to LLC.
After this, the company, in order to acquire ownership of the land plot on which the real estate was registered, bypassing the land auction procedure established by law, applied to the Kharkov City Council, providing the documents received under the above circumstances.
“The mayor’s office did not provide a proper assessment of these documents and, contrary to the requirements of land legislation, decided to sell, and subsequently entered into a corresponding agreement regarding a land plot, the area of which is more than 46 times greater than both the area of the mentioned “buildings” and the area of land required for their service,” the prosecutor’s office said.
As a result of such a “scheme,” a land plot, the market value of which currently amounts to more than UAH 1 million, was illegally removed from municipal property.
Due to the identified violations, the prosecutor's office filed a lawsuit, which took into account the prosecutor's arguments and decided to invalidate the purchase and sale agreement, obliging the LLC to return the land to communal ownership.
