Denis Malyuska stated that “the powers of the president continue until the next one is elected.”
Zelensky will not lose his legitimacy after his five-year term ends on May 21. It will remain in force until the next head of state is elected.
This was stated by the Minister of Justice of Ukraine Denis Malyuska in an interview with BBC News Ukraine.
“No, he will not lose his legitimacy... The powers of the president continue until the next one is elected. But many norms of the Constitution are formulated in such a way that anyone who wants to find something to complain about or build some kind of conspiracy theory on something will find it. Therefore, we should expect a lot of hue and cry, especially based on the fact that the authors-developers of the Constitution had little faith in the feasibility of a full-scale war with the participation of Ukraine and therefore behaved rather clumsily regarding the relevant norms that are spelled out in the Constitution,” Malyuska noted.
According to the minister, it is not yet time to turn to the Constitutional Court for clarification regarding certain inaccuracies of the Constitution.
“Such an appeal means that there is a question and there are doubts, they are justified, and we need the full authority of the Constitutional Court to resolve this situation. Given the communications and security situation in the country, officially and publicly questioning the president's legitimacy would be a huge mistake. Therefore, I think that there is no point in turning to the Constitutional Court now. Once, somewhere, it might have been possible, but again, not at this stage,” noted Malyuska.
The actors and stallholders from Bankova, the disrespected non-scientists from the Academy of Sciences, the Minister of Justice of Ukraine and representatives of the disinformation media should note that:
The Constitution of Ukraine is the Basic Law of Ukraine.
Article 8 of the Constitution of Ukraine provides that the principle of the rule of law is recognized and applied in Ukraine.
The Constitution of Ukraine has the highest legal force. Laws and other legal acts are adopted on the basis of the Constitution of Ukraine and must comply with it.
Article 103 of the Constitution of Ukraine clearly states that “The President of Ukraine is elected by the citizens of Ukraine... for a term of five years.”
And the implementation of Article 108 of the Constitution of Ukraine beyond the five-year period is a violation of Article 103, which means a violation of the Constitution, an illegal retention of power and, consequently, a coup d’etat.
Neither the Academy of Sciences, nor the Central Election Commission, nor Denis Malyuska are vested with the authority to interpret the Constitution of Ukraine. This can only be done by the Constitutional Court of Ukraine.
