The right to leave Ukraine during martial law applies to single fathers. This right is regulated by law, in particular, part 1 of article 23 of the Law of Ukraine “On mobilization preparation and mobilization.”
The State Border Service provides explanations on the procedure for crossing the border under martial law for single fathers. The main condition is the availability of documents confirming their status. Such documents include:
1. Birth certificate of the child (children).
This document confirms your paternity and relationship with the child.
2. Certificate of death of the child's mother.
In the event of the death of the child's mother, this document allows the single father to leave the country with the children.
3. A court decision to deprive the mother of parental rights.
If the mother is deprived of parental rights, this court decision also allows her to leave with the children.
4. Court decision to declare the mother missing.
If your mother is declared missing, the court's decision confirms your right to leave.
5. Court decision to declare the mother deceased.
If the mother is declared dead, this court order allows you to leave with the children.
Please note that these documents must be valid and executed in accordance with legal requirements. Provide yourself with all the necessary documentation in advance to avoid misunderstandings at the state border.
