On August 26, 2024, the HACS Appeals Chamber upheld the appeal of the SAPO prosecutor against the HACS verdict of June 14, 2021, by which the People's Deputy of Ukraine of the 8th convocation was found not guilty of illegally receiving compensation for the costs of renting a room at the Kyiv Hotel.
The appellate court agreed with the arguments of the SAPO prosecutor and issued a new sentence, which found the former deputy guilty of committing a crime under Part 2 of Art. 364 of the Criminal Code of Ukraine.
According to the verdict, he was sentenced to 3 years of imprisonment with deprivation of the right to hold positions in government bodies (except elected ones) for a period of 1 year and a fine of 8,500 hryvnia.
The decision of the court of appeal comes into force from the moment of proclamation and can be appealed in cassation procedure in the Supreme Court within three months.
It should be noted that this is the second time that the appellate court overturned an acquittal. Thus, on September 22, 2022, the HACC Appeals Chamber issued a guilty verdict against the indicated person. However, the Joint Chamber of the Supreme Court overturned this decision and sent the case for a new trial to the HACC Appeals Chamber.
Let us remind you that as part of the pre-trial investigation, SAPO prosecutors and NABU detectives collected enough evidence confirming that the people’s deputy had committed a criminal offense - the people’s deputy concealed the inheritance of an apartment in the capital and did not refuse compensation for housing. As a result, 361.5 thousand hryvnia compensation was illegally paid from the state budget.
