In 2020, the Office of the President introduced the concept of investment nannies for companies that will invest and create jobs.
In addition to tax benefits, they were guaranteed a ten-year perspective and a guarantee of stability.
In 2021, the current government announced an unprecedented update of investment legislation. It was planned to attract 10 billion euros annually to Ukraine only in terms of “green transformation”.
In 2023, the “green transformation” reached a level where the close circle of the Deputy Head of the Office of the President Rostislav Shurma, as owners of power plants in the occupied territories of Ukraine, receive funding from the state budget. At the same time, the financial committee of the Verkhovna Rada states that for two years the volume of attracted large investments is 0 UAH.
According to media reports, now Rostislav Shurma can be called an investment nanny from the state, to whom not only officials of the executive branch and state enterprises are accountable, but also executives of enterprises appointed in agreement with him after “expropriation,” no matter how they call it in the Office President.
NABU must promptly respond to signs of committed or planned corruption offenses in order to take appropriate measures. However, it seems that the pro-government candidacy for the post of director of NABU “broke” the institutional independence of NABU, and the impossible reform of the SAP only contributes to the swaying of the anti-corruption bloc by investment nannies from the Office of the President.
The reality is that in 2023, foreign investors, after unsuccessful appeals to NABU and SAP, are asking the government of the United States of America to intervene to stop the intrusive illegal tutelage of senior officials of Ukraine, which is in the nature of a raider takeover.
The foreign company JKX UKRAINE BV, as the owner of PJSC PC Ukrnaftoburenie, “transferred to temporary state management,” in its open letter to the US Embassy, states that two months after the crime statement was registered in June 2023, NABU did not investigate the facts set out in this statement and its supplement.
In the statements of JKX UKRAINE BV it was directly noted that the crimes provided for in Part 2 of Art. 366, part 2 art. 364, part 3 art. 382, part 5 art. 191 of the Criminal Code of Ukraine and committed by a group of persons, which includes officials of central executive authorities and law enforcement agencies, in particular, DBR employees were involved.
However, SAPO, after two months of inaction by NABU, clearly determined that the actions of investment nannies and other accomplices do not fall within the competence of NABU, and reclassified criminal offenses as articles of the Criminal Code that are convenient for investment nannies. These articles allowed SAPO to transfer the investigation to the DBI, that is, to one of the possible bodies where the accomplices of the group of people who committed the crimes reported by JKX UKRAINE BV work
The question remains which of the independent anti-corruption institutions listens more to the nannies from the Office of the President, NABU or SAPO.
It seems that none of the specially created bodies that received payment for their work from the state budget with simultaneous guarantees of control and careful supervision of investments from executive authorities is capable of fighting corruption within the country.
