Lyashko's ally and former deputy minister Averyanov was sentenced to 7 years in prison, but he fled abroad directly from the courtroom

The head of the federation of employers of the Chernihiv region and the former deputy minister of the Ministry of Emergency Situations from the party of Oleg Lyashko, Oleg Averyanov, was sentenced to seven years in prison. In addition, he was ordered to compensate his ex-wife Evgenia for material damage in the amount of more than 1.5 million hryvnia and 50,000 hryvnia for moral damage.

The corresponding verdict was pronounced by the Chernigov Court of Appeal on September 10, 2024. After this, information began to spread on the Internet that Averyanov himself fled abroad after the court verdict.

Took the car and resold it to another person

The subject of the dispute between the former Averyanov spouses after the divorce was the Porsche Cayenne. As stated in the case materials, on January 23, 2015, Oleg Averyanov, after a quarrel with his then-wife Evgenia, ordered his driver to drive the car away from the house where she lives. It was during that period that the couple began the process of divorce.

According to Evgenia, the Porsche was her property and was registered to her from the previous owner in Averyanov’s absence. Therefore, she regarded the disappearance of her car as theft and wrote a statement to the police.

At the same time, Averyanov noted that when he and his wife started talking about divorce, they verbally agreed that the apartment in Priluki would remain with Evgenia, and the car would remain with him. He did not admit his guilt and explained that he did not steal the Porsche. He considers it common property, which he bought with personal money from the profits received from the business. He added that he was ready, by court decision, to compensate half the cost of the car or return it to his ex-wife.

It is also mentioned in the case materials that Averyanov sold this car in Kyiv without his wife’s consent - without the relevant documents of purchase/sale and re-registration with one set of keys, because he allegedly lost the other and promised to hand them over later. The ex-wife learned about the sale of the car from the Goloseevsky police department in Kyiv. The Porsche buyer also learned from the police that the car has two owners. Subsequently, Oleg Averyanov returned the money to him.

What the Averyanov godfather and the mother of his ex-wife say

The Averyanovs' godfather and Evgenia's mother acted as witnesses in court. The latter said that she has “an excellent relationship with her son-in-law, and the relationship with her daughter is generally normal, but sometimes there are quarrels.” She also added that she saw the spouses quarrel and the division of property between them during the divorce in 2015.

Porsche Cayenne says that it came into the family in 2014, and it was not a gift, but a joint purchase. After all, both Oleg and Evgenia used the car. She also confirmed the thesis that there was an agreement between her daughter and son-in-law that she would have the apartment and he would have the car. However, they did not draw up or sign any documents. Subsequently, Evgenia allegedly consulted with someone and after that began to voice complaints against her ex-husband and demanded that he pay her money.

Kuma Averyanov noted that Oleg purchased the Porsche Cayenne in question from her husband in February 2014. They agreed on this purchase back in 2013, when their families were on vacation together. According to her godfather, after purchasing the car, Evgenia celebrated it as a birthday present.

According to the decision of the Supreme Court, all contracts or certificates for the sale of this car were canceled and declared invalid. According to this decision, Oleg Averyanov must return the Porsche Cayenne to Evgenia. However, this has not happened so far. At the same time, Averyanov does not remember where the car is, but a working set of keys and a technical passport for the car were and remain with Evgenia.

“He did not appear for the full verdict of the court”

By a verdict of the Chernigovsky District Court dated October 3, 2022, Oleg Averyanov was found not guilty in the case of illegal seizure of a car. After this, Evgenia filed another lawsuit with the Chernigov Court of Appeal to overturn the previous verdict and sentence Averyanov to 10 years in prison with confiscation of property.

She believes that her ex-husband wanted to take her car from her in advance. He also adds that Oleg did not have legal documents confirming him as a co-owner of the car.

The meeting of the Court of Appeal in Chernigov took place on September 10, 2024. According to the court verdict, Oleg Averyanov was sentenced to seven years in prison without confiscation of property. According to Part 4 of Article 532 of the Criminal Procedure Code of Ukraine, this sentence comes into force from the moment it is announced. At the same time, the term of serving the sentence is calculated from the moment of actual detention of the convicted person for execution of the sentence.

Representative of the Kyiv City Prosecutor's Office Irina Vinokurova, in a commentary to Public, said that Averyanov was present at the short announcement of the verdict, but did not appear at the full one.

“The full verdict of the court was supposed to be announced in a few hours. When a court decision is announced, a person is found guilty, but this does not mean that he is immediately detained in court. There is a procedure for executing a court decision. That is, the appellate court must send its decision to the court of first instance, and the court of first instance sends it for execution to the police at the place of residence of the person who was found guilty.”

The press secretary also explained the time frame within which court decisions must be implemented.

“The appeals court has seven days to return this case to the trial court. And the court of first instance must send it to the police for execution within three days. That is, in 10 days (from September 21, 2024 - ed.) the police must begin to implement this court decision. And then it will be clear whether the person is going to serve his sentence, or whether he is hiding.”

The main police department of the city of Kyiv did not provide the media with an answer: whether Oleg Averyanov was detained immediately after the court verdict and whether they confirmed or denied information about Averyanov’s probable crossing of the state border of Ukraine. The media also tried to get a comment from Oleg Averyanov himself.

On September 20, the Pozhmashina company published a video on its Facebook page indicating that their director Oleg Averyanov was at an agricultural exhibition in Poland and congratulated the team on the occasion of Machine Builder’s Day.

This exhibition took place from September 20 to 22 in Bednary, Poland. The website “Kobzarenko Plant” writes about this.

Oleg Averyanov's ex-wife, Evgenia, refused to comment.

Averyanov's lawyer Daria Svistula said in a comment that she is guided by the law on the legal profession and advocacy, which prohibits her from disseminating information about the client.
