The TCC cannot detain without the police, and the police cannot serve summonses without the TCC: details

Employees of the Territorial Recruitment Center for Social Support cannot detain citizens without the police. At the same time, the police cannot serve summonses without representatives of the TCC

The new law on mobilization indicates that TCC employees themselves do not have the authority to detain or deliver citizens to the TCC. This can only be done by the police if conscripts/reservists/reservists violate the rules of military registration, violation of defense legislation, mobilization training and mobilization.

In addition, Article 262 of the Code of Administrative Offenses states that the police cannot serve summonses, but only carry out administrative detention of those liable for military service who have violated military records. However, upon arrest, the police must draw up a report, which will indicate the date, place of arrest, information about the identity of the detainee, the reasons for the arrest and other characteristics. The police must also inform the relatives of the detainee about his whereabouts. Administrative detention can last no more than 3 hours

“As follows from the new acts, the TCC itself does not have the authority to detain and deliver citizens to the TCC. Such powers - and only in cases specified by law - are the police. And vice versa, the police cannot independently serve a summons without a representative of the TCC,” explains Judicial and Legal Newspaper.
