On May 17, 2024, the President signed the Law of Ukraine “On Amendments to the Code of Ukraine on Administrative Offenses to improve liability for violation of the rules of military registration and legislation on defense, mobilization training and mobilization” dated 05/09/2024 No. 3696-IX (hereinafter referred to as Law No. 3696).
Law No. 3696 amends the Code of Administrative Offenses (CAO) and establishes:
- a fine of 1,000 to 1,500 tax-free minimum incomes of citizens (nmdg; 17-25.5 thousand UAH) for violation of military registration rules during a special period by conscripts, those liable for military service, and reservists (Article 210 of the Administrative Code);
- fine from 2000 to 3500 NMDG (34-59.5 thousand UAH) on officials of state authorities, local governments, legal entities and public associations for violation of defense legislation, mobilization preparation and mobilization during a special period (Article 210 - 1 Code of Administrative Offences).
A fine will not be imposed if it is possible to obtain information about the personal data of a conscript, a person liable for military service, or a reservist in the Unified State Register of Conscripts, Persons liable for military service and other registers and databases of government bodies.
Law No. 3696 will come into force on the day following its publication.
We also recall that on May 9, the Verkhovna Rada adopted in the second reading bill No. 10379, which provides for increased liability for military offenses. According to this law, evaders face increased fines. The law provides for new articles regarding violation of military records, increasing the terms of administrative liability and introducing criminal liability for refusal of a medical examination during mobilization.
