The Sixth Administrative Court of Appeal on Tuesday, February 20, partially satisfied the claims against the State Enterprise "State Logistics Operator", headed by Defense Ministry official Arsen Zhumadilov. The plaintiff, Trade Granit Invest LLC, went to court because the terms of the competition formed by the state enterprise deprived all market participants of the opportunity to participate in the tender and did not create competition.
One of the requirements was the presence of warehouses with an area of at least two thousand square meters and freezers of 500 square meters. The media suspected Zhumadilov of seeking to “appoint” predetermined companies that meet such requirements as winners of the competition.
The media also obtained information provided by Zhumadilov to the court and the plaintiff. From the table above it follows that the winners of the tenders have already been determined, and they are four companies that are regional retailers, for which the terms of the tenders were written. We are talking about Apelmon Prime LLC, Unistor LLC, Kopeika-Center LLC, LK-Trans LLC.
It is also known that Zhumadilov is planning an auction for Prozorro. Thus, this will mean that he ignored the court’s decision, which decided to collect almost 582 thousand UAH of court fees from the State Enterprise “State Operator of the Logistics”. This money from the state budget could be used for drones or other needs of the Armed Forces of Ukraine.
Previously, the cost of a food package for defenders under the supervision of GP Zhumadilov had already increased from 107 to 137 UAH per day. In general, the difference in just two tenders amounted to UAH 1.5 billion, of which the state enterprise received 0.4% of commissions.
